기술의 발달로 인하여 막대한 정보를 한정된 물리적 공간에 집적하는 것이 가능해졌고, 이에 따라 최근 디지털 아카이빙 기술이 여러 분야에서 이용되고 있다. 디지털 아카이빙은 정보의 검색과 활용에 획기적인 방법을 제시하는 기술로서 현재 그 이용이 확대되고 있는 추세이나, 아직까지 그 법률적 문제점이 본격적으로 논의되지는 않고 있다. 디지털 아카이빙과 관련하여 미국에서는 이미 2건의 판결이 내려진 바 있는데, 2건 모두 공정사용(fair use)으로 인정되어 위법하지 않다고 판단되었다. 국내에서는 서울고등법원 2008. 3. 12.자 2007라872 가처분결정이 디지털원문 유통업체와 저작권신탁단체 사이에 발생한 디지털 아카이빙 분쟁에 관하여 판단하였는데, 저작권침해는 인정하면서도 보전의 필요성을 부인하여 결국 가처분신청을 기각하였다. 동 결정은 디지털 아카이빙과 관련하여 발생하게 되는 분쟁이 결국 저작권 이용대가의 문제로 귀결되는 것에 불과하다는 점을 지적하고 있어, 디지털 아카이빙의 활성화 방안과 관련하여 시사하는 바가 매우 크다고 생각된다. 디지털 아카이빙은 현행 저작권법상 도서관 면책 조항에 해당하지 않으므로, 원저작자나 출판업자로부터 허락을 받지 않은 디지털 아카이빙은 허용되지 않는다. 디지털 아카이빙은 디지털화와 집적화 과정에서 다수의 권리자들이 얽혀 있고, 현재 통용되고 있는 저작권 이용허락 계약서상 저작권 귀속에 관한 내용이 분명하지 않기 때문에 현행 저작권법 체계를 고수할 경우 디지털 아카이빙이 활성화되기는 현실적으로 매우 어렵다. 그러나 디지털 아카이빙은 사회 문화발전에 크게 기여할 수 있는 공익적 측면이 강하고, 그 성격상 필연적으로 방대한 정보의 집적을 요구하기 때문에, 입법론상으로는 보다 쉽게 디지털 아카이빙이 가능하도록 하는 새로운 제도의 도입을 검토해 볼 필요가 있다. 이에 관하여는 Opt-out 방식의 이용허락과 결합한 도서관 중심의 저작권집중관리제도가 현행 저작권법 체계에 대한 한 가지 대안이 될 수 있을 것으로 생각한다.

Technological improvements make it possible to accumulate an enormous amount ofinformation in a limited physical space and the technology of digital archiving is used in variousareas. Digital archiving is not a technology simply accumulating informations but it presents aninnovative measure of searching and operating informations, of which the use is remarkablyincreased. The issues on digital archiving particularly in regards of the library services have beenraised since 1990s and there have been some living discussions from the point of library science.Still, issues on digital archiving has not been earnestly discussed from the point of law so far.There were two decisions on digital archiving in United States, both of which concluded digitalarchiving to be a fair-use and not illegal. In Korea, 2007Ra872, Seoul High Court, March 12, 2008decided the case on digital archiving between digital text distributor and copyright managementcenter. Seoul High Court, admitting a copyright infringement, rejected the application for provisionaldisposition for lack of the necessity of a preservative measure. This decision implicates thatdisputes on digital archiving typically result in the issues of a royalty and a pecuniary compensation,and makes a great suggestion with regards to the methods of using digital archiving.As the current Copyright Act does not consider digital archiving as the library exemption, it isnot permitted to archive copyrighted works digitally without the authors’consents. Because thereare many participants concerned in the process of digitalization and archiving, and the clauses in thecopyright license contracts usually are not clear on the matter of the ownership, digital archivinghas a considerable potentiality of disputes. In practice, it seems almost impossible to facilitate theuse of digital archiving in the existing conditions of the current copyright system. Digital archiving has the very nature of the public interest that could contribute to the advance ofthe culture, and on the other hand, it needs to archive a huge amount of information. Therefore, it isnecessary to deliberate on the introduction of a new system from the legislative view which canfacilitate digital archiving more easily. It could be suggested as an alternative to develop thecopyright collective management system led by libraries and combined with opt-out licensingpolicy.
