뉴스 애그리게이터의 메커니즘을 살펴보면 주로 웹 크롤링, 트랜스 코딩, 프레임 링크 등과 같은 기술에 의하여 운행되고 있고 ‘제목+요약문’ 을 노출하는 방식에서 뉴스의 해당 문구가 창작성을 띠지 않는 경우에는 복제권 침해로 볼 수 없지 만 해당 문구가 창작성을 띤 경우에는 복제권 침 해로 인정해야 하고 현행 중국 저작권법상 임시복제에 대한 규정이 미비한 상황에서 ‘트랜스 코딩’ 행위의 적법성을 인정하여도 무방하다. 프레임 링크의 경우, 저작권법의 목적인 저작권자를 보호하여 창작적 인센티브를 부여함으로써 문화, 과학, 예술의 발전을 이룩한다는 논리에 가장 부합되는 것으로서 “실질적 표현기준”을 채택하여 정보통 신망전송권 침해책임을 인정하는 것이 바람직하다. 또한 뉴스 애그리게이터는 뉴스 저작물이라는 공익성을 띤 정보를 전파하는 것으로서 정보자유를 보장하기 위하여 미국의 ‘변형적 이용’원칙을 도입하여 공정이용 항변가능성도 인정할 수 있다고 하겠다.
결론적으로 중국의 실정을 살펴보았을 때, 정보의 자유로운 유통과 이용을 보장함과 동시에 사회에 질 높은 뉴스 저작물을 제공하기 위해서는 반부정당경쟁법, 상표법, 민사적 부당이득 등 저작권 이외의 법률에 의한 해결보다는 저작권법의 논리에 의한 해결이 뉴스 애그리게이터 관련 분쟁 해결에서 가장 효율적임을 알 수 있다. 또한 저작권법에 의한 규제방식 중에서도 독일식의 저작인 접권의 신설이거나 각종 저작권 허락제도를 검토 한 결과 현실적으로 많은 어려움과 문제점들이 존재하기에 뉴스 애그리게이터 관련 법적 분쟁은 입법론 적인 해결보다 해석론적인 해결방식이 더욱 적합하다고 판단되었다.

영어 초록

The mechanism of the news aggregator, it mainly operates through technologies such as web crawling, trans-coding, frame link and so on. Through the legal analysis of this mode of operation, we examined whether the news aggregator infringes the reproductive rights and information network propagating rights, and whether there is any unfair competition behavior. As a result, we find that in the way of exposing “title + abstract”, if the phrase does not become creative, it is not infringement of reproduction rights, but if it is creative, it should be recognized as infringement of reproduction right. Under the current Chinese Copyright Act, there is no provision for temporary reproduction, so the “trans-coding” should be considered legal. In the case of the frame link, the criteria of judging the infringement of the legal regulations and judicial interpretation are unclear and there is also different standard in theoretical such as “server standard”, “user detection standard”, “substantial presentation standard” and so on. However, to comply with the logic of achieving the development of culture, science, and art by protecting copyright holders for the purpose of copyright law, it is necessary to adopt the “substantial expression standards” as the most reasonable standard. Subsequently, news aggregator is a news propaganda that propagates information with the public interest that it is a news work, and in order to guarantee freedom of information, it has a legal permission system which is a restriction of author’s property right related to news aggregator. And I suggest that we should adopt the “transformative use” principle as the fair use standard. In conclusion, considering the reality of China, it is necessary to recognize the infringement of the frame link by “substantial presentation standard” and at the same time we should adopt the “transformative use” as a standard to provide the possibility that a good news aggregator can be acknowledged as fair use. In conclusion, in order to guarantee the free circulation and use of information and to provide high-quality news works to society, using copyright law to resolve the disputes related news aggregator is more effective than using anti-free competition law, trademark law and civil law. In addition, among the regulatory methods based on the copyright law, there are many difficulties and problems in the realization of the German-style resolution or the various copyright permission systems. As a result, the legal disputes related to the news aggregator should be resolved by the interpretation of copyright law rather than the way of legislation.
