Abstract

UN은 전체인구 중에서 65세 이상의 노인인구가 차지하는 비율이 7% 이상인 사회를 ‘고령화 사회’라고 하고, 14% 이상인 사회를 ‘고령사회’라고 하며, 20% 이상인 사회를 ‘초고령사회’라고 하는데 우리나라의 경우에도 전체인구 대비 노인인구 추세를 보면 급격히 인구의 고령화 추세를 보이고 있다. 통계청이 발표한 고령자 통계에 의하면, 우리나라 노인인구는 2007년 12월 4,810,363명으로 전 체 인구의 9.9%를 차지했고, 이는 2000년 노인인구가 3,394,896명으로 전체인구 의 7%를 넘어 ‘고령화사회’로 진입한지 7년 만이라고 한다. 또한 2018년에는 ‘고 령사회’에 진입하고, 2026년에는 ‘초고령사회’에 들어설 것으로 추산하고 있다. 최근에 사회적으로 노인인구가 증가하면서 노인범죄가 증가하고 있는 추세에 있다. 이러한 노인범죄의 증가는 결과적으로 노인수형자의 증가를 가져오고 있으며 이들에 대한 처우가 고령화사회의 대두와 더불어 주요한 교정현안으로 대두되고 있다. 미국의 경우에는 노인수형자의 증가에 대하여 교정당국이 우려하고 있으며 수형자들의 특성에 맞는 수용환경조성, 수형자들에게 적합한 시설·장비, 프로그램 도입, 특별한 요구를 지닌 수형자들의 처우 비용증가에 관한 문제, 교도관들에 대한 적절한 교육실시의 문제 등을 중점적으로 해결하고 있으며, 일본의 경우에는 교정당국에서 우리와 같은 65세 이상의 수형자를 정의하여 처우하고 있는데 중요한 문제 중의 하나로 인식하고 있으며 처우는 수형자들의 소질과 환경 등의 여러 가지 사항들을 종합하여 안정적이고 온화한 처우가 될 수 있도록 하고 있다. 본 연구에서는 노인수형자의 효율적인 처우방안으로 첫째, 사회내처우의 활성화, 둘째, 노인전용 프로그램의 도입, 셋째, 전문적 의료처우의 강화, 넷째, 노인전담 교도소 설치, 다섯째, 민영교도소에의 위탁 등을 제시하였 다. 특히 노인수형자는 젊은 수형자들과는 다르게 나이·건강상태 및 신체적 특성 등을 고려하여 처우에 있어 적정한 배려를 하여야 할 것이다.

영어 초록

UN defines 'aging society' as society that is over 7% in the ratio of being possessed by the elderly population at the age of over 65 out of the whole population, 'aged society' as society whose ratio is more than 14%, and 'super-aged society' as society whose ratio is over 20%. Even in case of our country, given seeing trend in the elderly population as against the whole population, the trend of rapid aging in population is being shown. According to statistics for the aged announced by Korea National Statistics Office, the elderly population in our country possessed 9.9% of the whole population with 4,810,363 people in December of 2007. This is said to have been 7 years since entering 'aging society' as the elderly population in 2000 surpassed 7% of the whole population with 3,394,896 people. Also, it is estimated to enter 'aged society' in 2018 and to enter 'super-aged society' in 2026. As the elderly population increases socially these days, the elderly crime is in the rising trend. This rise in the elderly crime brings about an increase in the elderly inmates. The treatment for these people is being emerged as the major pending question about remediation along with the appearance of aging society. In case of America, the remediation authorities are worrying about a rise in the elderly inmates. It is intensively solving the acceptance-environment formation in line with inmates' characteristics, introduction of appropriate facility·equipment, and program, problem about health·hygiene, and problem about prison officers' suitable execution in education. In case of Japan, the remediation authorities are treating by defining inmates at the age of over 65 like us, and are recognizing it as one of important problems. Treatment is allowed to be stable and warm treatment by synthesizing several kinds of matters such as inmates' quality and environment. As a plan for efficient treatment in the elderly inmates, this study suggested first, activation of community treatment, second, introduction of elderly-only program, third, reinforcement in professional medical treatment, fourth, installation in a correction institution exclusively for the elderly, and fifth, commission of private prison. In particular, the elderly inmates will need to be considered appropriately in treatment by considering age, healthy condition, and physical characteristics differently from young inmates.
